Tort law is a very large category of common law which basically means civil wrongs which can also extend to being criminal. Any tort be it criminal or not that is recognized by the law is ground for a lawsuit.

As with any different types of laws, tort can be the result of many types of actions. The dominant action that results in tort is “negligence”. Put simply, negligence is when someone of an entity has a “duty of care” towards its clients or the public but has neglected to do so and as a result someone or something was injured or damaged.

Another common action that can also result in tort is “Nuisance”. It deals with acts of interference with the use and enjoyment of a plaintiffs land. Basically its when other people of representatives of business entities that act as irritants to the land owner. This may be in the form of bad smells, drainage run-off, improper rubbish treatment or any number of other things which causes “nuisance”.

Tort can also result from acts of “defamation”. It is divided into two parts, namely “slander” and “libel”. Slander is spoken defamation while Libel is written defamation. It is important that people understand that defamation is considered to be relatively hard to prove as it requires that the accused be proved to make a factual accretion which the facts cannot be proven to be true. Opinions about people and their conducts can’t be considered defamation.

Another type of tort that people should be aware of is “intentional tort”. It basically means any act that can be reasonably foreseen to cause harm to another individual. These can again be narrowed down to other subcategories like assault, battery, false imprisonment, infliction of emotional distress and fraud.

Another type of tort is called “Economic Tort” which protects people and businesses from interference with their trade. It has however to be said that economic tort laws have been diluted over the years with the intervention of more modern anti-trust, labor and competition laws which is said to level out the playing field.
